Auction Terms and Conditions
“Company” means Union Auction Public Company Limited
“Seller” means a financial institution, insurance company, car rental business company, a natural person, a juristic person who is the legal owner of the property
“Buyer” means a natural person, a juristic person who wins the auction from the auction
“Assets” mean cars, motorcycles, trucks, agricultural vehicles, chattel, real estate, including other products regarded as used goods

The Company is a service provider for auctioning assets between buyers and sellers by way of bidding.

Assets put up for auction are considered used goods. Quality may not be perfect. It is sold as it is, and does not conceal information about the property or car condition in any way, some information cannot be verified.

The buyer is responsible for checking the details of the product, conditions, and specifications of the product before bidding. The company reserves the right not to be liable for any errors that occur after the auction. It is assumed that the buyer knows and accepts the condition of the item and the company does not accept any change or return.

For assets in the category of cars sold by auction, the company reserves the right to inspect the catalytic system, and converter due to technical limitations.

For assets of cars sold by auction, the company reserves the right to guarantee the transmission system of all types of cars and the mileage displayed on the odometer. Due to the limitation of the area and speed of the test, the company does not guarantee whether the mileage has been adjusted or not. There may be a discrepancy in the mileage displayed on the car's odometer as shown in the auction listing and on the website, however, the discrepancy does not exceed 99 kilometers.

Vehicles that are sold by auction have canceled the Act and the insurance policy.

Assets in the type of cars that can be sold, the company increases coverage for specific models or cars only.

Fire insurance coverage, the coverage period is 48 hours since the buyer picks up the car and takes the car out of the company. If an incident occurs under the terms of the fire policy, the company or the car buyer can claim the damage incurred according to the auction price, but not exceeding 400,000 Baht per car (excluding VAT and auction fees).

Car insurance coverage type 2, coverage period of 45 days from the date the buyer bids. Coverage limit per insured vehicle under the terms of the insurance policy according to the price of the car that can be auctioned, but not more than 400,00 Baht per car (excluding VAT and auction fees).

The buyer is responsible for the expenses related to registration of ownership transfer and acceptance of transfer of ownership, transportation costs, taxes, fines/surcharges, stamp duty, and other expenses (if any), including registration fees for applying for a new car (In case of a notice to stop using the car) as well as the corporate car tax transferred 2 times or more (if any), depending on each item as stated in the auction list.

The buyer is responsible for inspecting the condition of the goods and signing a confirmation of receipt of the goods before taking the product out of the company's area or signs to confirm receipt of the goods when taking the car out of the company area within 3-5 days (in case of moving) if the buyer does not inspect the product condition, the company reserves the right not to consider requesting a return of the car. It is considered that the buyer agrees to receive the product in such condition, and waives the right to claim any damages incurred thereafter.

The company does not accept the return of the vehicle in case the vehicle cannot be financed, the vehicle is in the status of a car blacklist, or the vehicle claims insurance (Total loss) which is not detailed in the registration book on page 18.

Every auction shall be recorded via both audio and video and recorded by CCTV cameras.

The company reserves the right to change the price and auction conditions in accordance with current conditions, and market forces without prior notice.

The company reserves the right to consider jointly with the seller. Approve or disapprove the sale of the property to the bidder. In case of force, majeure or other reasonable reasons, the results of joint consideration shall be final.

The buyer must study the conditions of bidding, payment, and transfer of ownership. Accept and agree to comply with the terms and conditions announced by the company.
Auction process
Registration to participate in the auction

Those interested in participating in the auction at the auction can register or pre-register and deposit collateral for the auction number plate for automobiles and agricultural vehicles, 20,000 Baht, for motorcycles, 5,000 Baht in cash, cashier's check payable to United Auction Plc., United Auction QR Code and credit card.

Those interested in participating in the online auction can register to participate in the auction by applying for membership and transferring payment of collateral according to the same criteria as participating in the auction under No. 1. to receive a member number and confidential code for online bidding.
The company will keep the information of the registrant confidential without using all or part of the information, any part of the information to be published to the public, third parties or to use the information obtained to seek benefits in any commercial service including not using the information obtained for any action unless consented by the registrant or is necessary for legal purposes only.

Bidder shows purchase intention
Express your intention to buy by raising the auction number plate at the auction or by clicking on the purchase price online.
Bid price adjustment
The auction will start from the middle price if there is more than one bidder.

Cars priced no more than 1 million Baht, the spokesperson shall increase the price by 2,000 Baht per time.

Cars priced from 1 million Baht or more, the spokesman shall increase the price by 10,000 Baht per time.

Motorcycles priced no more than 100,000 Baht, the spokesman shall increase the price by 1,000 Baht per time.

Motorcycles priced at 100,000 Baht or more, the spokesman shall increase the price by 2,000 Baht per time.

Agricultural vehicles, the spokesperson shall increase the price by 2,000 Baht per time.
The highest bidder wins the auction.
In case there are equal bids and at the same time between bidders at the auction and online bidders, the Company reserves the right to announce the bid at the auction as the winning bidder.
Fee / Processing fee (including VAT) per vehicle
- Car 10,700 Baht
- 6 - wheels truck 12,840 Baht
- Motorcycles under 200 cc 1,605 Baht
- 10 – wheels truck 16,050 Baht
- Motorcycle from 200 cc or upwards 3,210 Baht (or as specified in the items)
- Agricultural vehicle 9,630 Baht
- Combine harvester, tractor 1,070 Baht
- The bidder's name change fee is 3,000 Baht per vehicle per name change for the car price at the end of the auction less than 10,000 Baht.
- The bidder's name change fee is 30% of the auction price per vehicle per name change, for the car price, the auction ends from 10,000 Baht.
Payment

In the case of the buyers bidding at the auction, they must sign the bid confirmation document.
In the case of the buyers bidding online, they can print proof of bid from the purchase list.

In case of full payment
-
Within the auction day, the buyer must pay the processing fee, moving fee, other relevant service fees (if any), and the full cost of the car including other expenses as notified in the invoice as well as the full amount of VAT.

After the buyer has paid in full, the buyer can take the car within that date or within 7 working days from the auction date, else the company reserves the right to take action as the company deems appropriate.

In case of partial payment

Within the auction day, the buyers must pay the processing fee, moving costs, and other service charges relevant (if any) plus VAT in full amount.

Within the auction day, the buyers must pay a minimum deposit of 10 – 20 percent of the auctioned car price. (plus, VAT) (depending on each seller's conditions) or a minimum of 20,000 Baht (plus VAT) in the case of a car whose auction price is less than 200,000 Baht, or a minimum of 5,000 Baht (plus VAT) in the case of a motorcycle whose auction price is less than 50,000 Baht, and other expenses (if any) as stated in the note in full.

Remaining payment, the buyers must pay within 4 working days of bidding at the head office and Rangsit Klong 8 branch. In the case of bidding for provincial branches, the buyers must pay within 3 business days.

After the buyers have paid in full, the buyers can take the car within that date or within 7 working days from the auction date, else the company reserves the right to take action as the company deems appropriate.
*** Payment within the auction day according to item 2. or item 3. The buyer must make payment within the company's business hours (6:00 p.m.) or within 1 hour after the auction ends

In case the buyer does not comply with the payment terms, if the buyer does not pay the remaining 90 percent, the company reserves the right to forfeit the deposit within the auction date in No. 3.2 or forfeit the security if the buyer fails to pay 10 - 20 percent of the auction price. And can cancel the sale or bring the car according to the item that has been sold back from the buyer.

Registration book

Registration book and ownership transfer document the buyer shall receive approximately within15-30 business days (depending on each seller, depending on the case), for both corporate vehicles and guest cars.

Transfer of Ownership, the buyer must complete the transfer of ownership at the provincial transport office within 60 days from the auction date or depending on the conditions of each seller.
In case the buyer does not transfer the ownership within the said period, if later it was found that the owner or possessor was ordered by the government agency to pay the fine (traffic case) including fines in all cases or witness in case of illegal use of the vehicle (Civil/Criminal cases), the buyer shall be responsible for all damages claimed in any case.
In case the buyer proceeds to transfer ownership according to No. 2., the engine number and chassis number have problems due to welding marks, and editing because the company was not notified in the list or additional announcements as a result of which the ownership could not be transferred by the decision of the Department of Land Transport staff, the buyer must return the vehicle within 7 working days from the date of non-transferability. If the said deadline has passed, the company reserves the right not to accept the return of the car.
However, the company will return only the processing fee, the price of the car that can be auctioned, and the expenses reported in the listing only.

In case the buyer does not comply with the terms of ownership transfer, No. 2. causing the ownership transfer document to expire, there will be a cost for requesting a new document issuance which depends on the conditions of each seller, such charges are the responsibility of the buyer.

In case of not picking up in person, shall bring power of attorney, copy of identification cards of the principal and the attorney with a certified true copy signature.
4.2 Pickup via EMS post office, the buyer must inform the vehicle registration department of the company to deliver the registration book and transfer documents as the company offers free delivery.
